These Terms of Service ("Terms", "Agreement") govern your access to and use of the EasyFix Expert website, mobile applications, call centers, booking systems, customer dashboards, technician portals, and all related services (collectively, the "Platform"). By accessing, booking, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
EasyFix Expert operates as a **franchise-enabled service coordination platform**. Certain services requested through the Platform may be fulfilled by **independently owned and operated franchise partners**, authorized service centers, or third-party technicians ("Service Partners"). EasyFix Expert itself does not always perform physical appliance repair or installation services.
These Terms clearly define:
- The legal relationship between customers and franchise partners
- The role and limitations of EasyFix Expert as a platform operator
- Payment, cancellation, warranty, and liability boundaries
- Customer responsibilities and dispute resolution processes
1. Definitions
For the purposes of this Agreement, the following definitions apply:
- "EasyFix Expert", "Company", "we", "us", "our" means EasyFix Expert Private Limited and its affiliated entities operating the Platform.
- "Platform" means the EasyFix Expert website, mobile applications, customer service channels, and digital infrastructure used to facilitate service bookings, payments, communications, and support.
- "Customer", "you", "your" means any person or entity that accesses or uses the Platform to request or receive services.
- "Franchise Partner" means an independently owned and operated business entity authorized by EasyFix Expert to provide services under the EasyFix Expert brand in a defined geographic territory.
- "Service Partner" means franchise partners, authorized service centers, contractors, technicians, or third-party providers that fulfill services requested through the Platform.
- "Services" means appliance repair, installation, inspection, maintenance, cleaning, diagnostics, spare part replacement, and related home services available through the Platform.
- "Booking" means a service request submitted by a Customer through the Platform.
- "Service Agreement" means the contractual relationship formed between the Customer and the Service Partner upon acceptance of a Booking.
- "Content" means all text, graphics, software, interfaces, logos, trademarks, documentation, videos, and other materials displayed on or accessible via the Platform.
- "Fees" means all charges payable by a Customer for Services, including service charges, diagnostics fees, labor costs, spare parts, taxes, cancellation charges, and platform fees.
- "Territory" means the geographic area assigned to a Franchise Partner for service fulfillment.
- "Force Majeure" means events beyond reasonable control, including natural disasters, strikes, pandemics, acts of government, network outages, or failures of third-party infrastructure.
2. Platform Role & Franchise Structure
EasyFix Expert operates a technology-enabled marketplace and service coordination platform that connects Customers with independent Franchise Partners and Service Partners for home appliance services.
Unless explicitly stated otherwise in writing, EasyFix Expert itself does not provide physical appliance repair or installation services. Instead, such services are fulfilled by independently owned franchise partners operating under the EasyFix Expert brand or by authorized third-party providers.
Each Franchise Partner is:
- Legally independent from EasyFix Expert
- Responsible for its own staff, technicians, and operations
- Solely liable for the quality, workmanship, and execution of services provided
- Responsible for complying with all applicable laws, licensing, and regulatory requirements
EasyFix Expert does not:
- Employ technicians directly unless explicitly stated
- Control the daily operations of Franchise Partners
- Guarantee outcomes, timelines, or technical results of services
- Assume liability for negligence, errors, omissions, or misconduct of Franchise Partners
By booking a service through the Platform, you acknowledge and agree that:
- Your service contract is directly with the Service Partner fulfilling the service
- EasyFix Expert acts solely as a facilitator, technology provider, and brand coordinator
- Any on-site service is performed by independent Service Partners, not by EasyFix Expert employees
3. User Eligibility & Account Registration
You must be at least 18 years of age and capable of entering into legally binding contracts under applicable law to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.
You may be required to create an account or provide personal information to access certain features of the Platform. You agree to provide accurate, complete, and up-to-date information and to promptly update such information as necessary.
You are solely responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Ensuring that unauthorized users do not access your account
EasyFix Expert reserves the right to suspend or terminate accounts that contain false information, violate these Terms, or pose security or compliance risks.
4. Service Bookings & Contract Formation
When you submit a Booking through the Platform, you are submitting a service request, not a binding contract. A binding service contract ("Service Agreement") is formed only when a Service Partner accepts your Booking.
Service availability, scheduling, technician assignment, spare part availability, and final service pricing are determined by the Service Partner fulfilling the Booking and may vary by location, appliance type, service category, and market conditions.
EasyFix Expert reserves the right to:
- Reject or cancel Bookings at its discretion
- Reassign Bookings to alternative Service Partners
- Modify service workflows, operational processes, and platform features
You acknowledge that:
- Quoted prices may be estimates and subject to change after inspection
- Final charges may depend on diagnostics, labor complexity, and spare parts used
- Service timelines are not guaranteed
- Completion dates are estimates only
5. Payments, Pricing & Taxes
Customers agree to pay all Fees applicable to Services booked through the Platform. Fees may include:
- Inspection or diagnostic charges
- Labor and service charges
- Spare parts and materials
- Platform facilitation fees
- Applicable taxes, duties, and regulatory charges
Prices displayed on the Platform may be indicative and subject to change based on:
- Actual diagnosis results
- Spare part availability and pricing fluctuations
- Service complexity
- Geographic service area
Payments may be collected:
- Online through third-party payment gateways
- In-person by Service Partners
- Via invoices issued post-service
EasyFix Expert may collect payments on behalf of Service Partners as a payment facilitator and may remit funds to Service Partners after deducting platform fees and applicable charges.
You authorize EasyFix Expert and its payment service providers to:
- Process payments using your chosen payment method
- Store payment credentials in accordance with applicable regulations
- Initiate refunds, adjustments, or chargebacks where required
All prices are exclusive of taxes unless explicitly stated. You are responsible for all applicable taxes, duties, and regulatory charges associated with your service bookings.
6. Cancellations, Rescheduling & Refunds
Cancellation, rescheduling, and refund policies may vary by Service Partner, service category, and geographic location. Applicable policies will be disclosed at the time of booking or prior to service execution.
You may be charged cancellation or rescheduling fees if:
- You cancel after technician dispatch
- You are unavailable at the scheduled service time
- You provide inaccurate service details
- You refuse service after inspection without valid cause
Refunds, where applicable, may be issued:
- To the original payment method
- As wallet credits
- As service vouchers
EasyFix Expert reserves the right to determine refund eligibility and refund method in accordance with applicable policies and contractual arrangements with Service Partners.
7. Service Warranty & Quality Disclaimer
Any warranties related to services, spare parts, or materials are provided solely by the Service Partner or manufacturer, not by EasyFix Expert, unless explicitly stated otherwise in writing.
EasyFix Expert does not guarantee:
- Service success or resolution of appliance issues
- Long-term functionality of repaired appliances
- Availability of original manufacturer parts
- Compatibility of replacement components
Any post-service complaints must be raised directly with the Service Partner who performed the service, subject to their warranty policies and service guarantees.
EasyFix Expert may assist in facilitating communication but does not assume responsibility for warranty enforcement or service remediation.
8. Customer Responsibilities
As a Customer, you agree to:
- Provide accurate appliance details and service descriptions
- Ensure safe and reasonable access to service locations
- Disclose known appliance issues, hazards, or defects
- Secure pets, valuables, and hazardous materials
- Comply with technician safety protocols
- Pay all applicable Fees promptly
You acknowledge that failure to comply with these responsibilities may result in:
- Service delays or cancellations
- Additional charges
- Denial of refunds
- Termination of service eligibility
9. Intellectual Property
All intellectual property rights in the Platform, Content, trademarks, logos, software, workflows, designs, service methodologies, documentation, and branding materials are owned by or licensed to EasyFix Expert.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for lawful, personal, and non-commercial purposes.
You may not:
- Copy, reproduce, modify, distribute, or display Content without authorization
- Reverse engineer, decompile, or disassemble Platform software
- Use trademarks, logos, or branding without written permission
- Create derivative works based on Platform assets
10. User Content & Feedback
You may submit feedback, reviews, ratings, testimonials, comments, images, or other content ("User Content") through the Platform.
By submitting User Content, you grant EasyFix Expert a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and publish such User Content for marketing, operational, analytical, and improvement purposes.
You represent and warrant that:
- You own or control all rights in the User Content
- User Content does not infringe intellectual property rights
- User Content does not violate privacy, publicity, or contractual rights
- User Content is not unlawful, defamatory, obscene, or misleading
EasyFix Expert reserves the right to remove or moderate User Content at its sole discretion.
11. Prohibited Activities
You agree not to:
- Use the Platform for unlawful or fraudulent purposes
- Impersonate another person or entity
- Interfere with or disrupt Platform security or operations
- Access systems or data without authorization
- Upload malware, viruses, or harmful code
- Scrape, crawl, or extract Platform data without consent
- Manipulate pricing, reviews, or ratings
- Harass, threaten, or abuse Service Partners or staff
- Use the Platform in a manner that violates applicable laws
12. Suspension & Termination
EasyFix Expert reserves the right to suspend or terminate your access to the Platform, in whole or in part, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent or abusive conduct
- Non-payment of Fees
- Security risks or system abuse
- Legal or regulatory compliance requirements
Upon termination, your right to use the Platform ceases immediately, but provisions relating to intellectual property, liability limitations, dispute resolution, and indemnification survive termination.
13. Disclaimer of Warranties
THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
EASYFIX EXPERT DOES NOT WARRANT THAT:
- The Platform will be uninterrupted, secure, or error-free
- Defects will be corrected
- Service outcomes will meet your expectations
- Technicians will achieve specific results
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYFIX EXPERT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, PROPERTY DAMAGE, OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO:
- Your access to or use of the Platform
- Services performed by Franchise Partners or Service Partners
- Errors, omissions, delays, or service failures
- Unauthorized access to or alteration of your data
- Third-party conduct or content
IN NO EVENT SHALL EASYFIX EXPERT’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, OR INR 10,000, WHICHEVER IS LESS, TO THE EXTENT PERMITTED BY LAW.
15. Indemnification
You agree to indemnify, defend, and hold harmless EasyFix Expert, its directors, officers, employees, affiliates, licensors, franchise partners, agents, and contractors from and against any claims, liabilities, damages, losses, costs, expenses, or demands (including reasonable attorneys' fees) arising out of or relating to:
- Your use or misuse of the Platform
- Your violation of these Terms
- Your violation of any law or third-party rights
- Content you submit through the Platform
- Disputes between you and Service Partners
16. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or Services shall first be attempted to be resolved through good faith negotiations between the parties.
If the dispute cannot be resolved through negotiation within thirty (30) days, the dispute shall be referred to and finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), as amended.
The seat and venue of arbitration shall be Chennai, Tamil Nadu, India. The arbitration shall be conducted in the English language by a sole arbitrator appointed in accordance with applicable law.
Nothing in this clause shall prevent EasyFix Expert from seeking injunctive or equitable relief in any court of competent jurisdiction for the protection of its intellectual property, confidential information, or business interests.
17. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Subject to the arbitration clause above, the courts located in Chennai, Tamil Nadu, India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Platform.
18. Force Majeure
EasyFix Expert shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, strikes, labor disputes, acts of government, war, terrorism, riots, internet outages, power failures, or failures of third-party infrastructure.
During a Force Majeure event, affected obligations shall be suspended for the duration of the event.
19. Modifications to Services & Terms
EasyFix Expert reserves the right to modify, suspend, or discontinue any aspect of the Platform or Services at any time, with or without notice.
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
20. Communications & Notices
By using the Platform, you consent to receive communications from EasyFix Expert and Service Partners electronically, including via email, SMS, push notifications, in-app messages, or phone calls, regarding your account, service bookings, promotions, security alerts, and operational updates.
You may opt out of promotional communications at any time by following the unsubscribe instructions provided or by contacting customer support. Transactional and service communications are necessary for service delivery and cannot be fully opted out of.
21. Third-Party Services & Integrations
The Platform may integrate with or link to third-party services, applications, payment gateways, logistics providers, CRM tools, analytics platforms, and communication providers.
EasyFix Expert does not control and is not responsible for the content, availability, security, practices, or policies of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
22. Confidentiality
You agree to maintain the confidentiality of any proprietary, confidential, or non-public information disclosed by EasyFix Expert or Service Partners, whether orally, visually, electronically, or in writing, including but not limited to pricing structures, business models, technical systems, workflows, customer data, franchise operations, manuals, and internal policies.
You shall not disclose, use, or exploit confidential information for any purpose other than as necessary to use the Platform and Services lawfully.
23. Data Protection & Privacy
Your personal data is collected, processed, stored, and protected in accordance with our Privacy Policy, which forms an integral part of these Terms.
By using the Platform, you consent to the collection and processing of your personal data as described in our Privacy Policy, including data sharing with Franchise Partners and Service Partners for service fulfillment purposes.
24. Franchise Partner Relationship Clarification
EasyFix Expert authorizes Franchise Partners to operate under the EasyFix Expert brand within defined geographic territories. Each Franchise Partner is an independent contractor and not an employee, agent, joint venturer, or legal representative of EasyFix Expert.
Nothing in these Terms shall be deemed to create:
- An employer-employee relationship between EasyFix Expert and any Service Partner
- A partnership or joint venture between EasyFix Expert and any Franchise Partner
- An agency relationship permitting Franchise Partners to bind EasyFix Expert legally
Franchise Partners do not have authority to:
- Bind EasyFix Expert to contracts or obligations
- Modify Platform policies or pricing structures
- Make warranties or representations on behalf of EasyFix Expert
- Assume liabilities on behalf of EasyFix Expert
Customers acknowledge and agree that any service issues, disputes, damages, losses, injuries, or claims arising from on-site service performance must be resolved directly with the Service Partner that performed the service, subject to applicable laws.
25. Insurance & Risk Allocation
Franchise Partners and Service Partners are required to maintain appropriate insurance coverage, including but not limited to:
- Commercial general liability insurance
- Workers' compensation insurance
- Professional indemnity insurance
- Any other insurance required by law or franchise agreements
EasyFix Expert does not provide insurance coverage for Customer property, appliances, or personal belongings and shall not be responsible for losses or damages resulting from service execution by Service Partners.
26. Health, Safety & Property Damage
Customers are responsible for providing a safe working environment at service locations, including safe access, electrical safety, ventilation, lighting, and workspace conditions.
EasyFix Expert shall not be liable for:
- Injuries to Service Partners or technicians
- Damage caused by pre-existing appliance defects
- Damage resulting from unsafe working conditions
- Consequential property damage arising from service execution
Any claims relating to injury, damage, or loss must be raised directly with the Service Partner performing the service.
27. Manufacturer Warranties & Third-Party Products
Certain services may involve replacement parts, accessories, consumables, or materials manufactured by third parties. Manufacturer warranties, if any, are provided solely by the manufacturer and not by EasyFix Expert.
EasyFix Expert does not guarantee:
- Availability of original manufacturer spare parts
- Compatibility of third-party replacement parts
- Warranty coverage for non-original parts
- Performance or durability of third-party components
Any warranty claims relating to parts must be directed to the manufacturer or Service Partner supplying such parts.
28. Service Interruptions & Operational Risks
Service delivery may be affected by:
- Weather conditions
- Traffic delays
- Power outages
- Equipment shortages
- Labor shortages
- Supply chain disruptions
- Government restrictions
- Public health emergencies
EasyFix Expert shall not be liable for service delays, cancellations, or failures resulting from such operational risks.
29. Non-Solicitation & Non-Circumvention
Customers agree not to directly solicit, hire, engage, or contract with Service Partners or technicians introduced via the Platform outside the Platform for competing services, except as expressly permitted in writing by EasyFix Expert.
Circumventing the Platform may result in account suspension, service denial, and legal action, including claims for lost revenue, damages, and injunctive relief.
30. No Professional Advice
Information provided on the Platform, including service descriptions, troubleshooting guides, recommendations, and content, is for general informational purposes only and does not constitute professional, engineering, electrical, plumbing, mechanical, or legal advice.
Customers should consult qualified professionals for appliance-specific diagnostics and safety assessments.
31. Assignment
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of EasyFix Expert. Any attempted assignment in violation of this clause shall be null and void.
EasyFix Expert may freely assign or transfer these Terms in connection with a merger, acquisition, restructuring, asset sale, or similar transaction.
32. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
33. Waiver
No failure or delay by EasyFix Expert in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise preclude any further exercise of such right, power, or remedy.
34. Entire Agreement
These Terms, together with the Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and EasyFix Expert regarding the Platform and Services and supersede all prior or contemporaneous agreements, communications, or understandings, whether written or oral.
35. Survival
Provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, confidentiality, governing law, and franchise separation shall survive termination or expiration of these Terms.
